Services FAQs

  • Why is regulatory compliance important for international businesses?

Regulatory compliance determines whether a business can legally operate at all: it governs whether licenses are granted and kept, whether contracts and transactions can be executed without being unwound by a regulator, and whether counterparties are willing to do business with it once they've run their own due diligence. A gap in any of these areas doesn't just create a fine, it can stop the business from operating in that market until the gap is fixed.

  • How can businesses maintain compliance across multiple jurisdictions?

Businesses maintain compliance across multiple jurisdictions by building a distinct compliance framework for each one against that jurisdiction's actual licensing, AML, and reporting requirements, rather than exporting one jurisdiction's framework to another. Central oversight still matters, a single point of visibility that tracks obligations and deadlines across all entities, but it coordinates locally-built frameworks rather than replacing them with a common template.

  • What are AML and KYC obligations?

AML and KYC obligations require a business to maintain an adequate compliance function, built around an AML/CTF/CPF framework that covers customer due diligence (verifying client and beneficial ownership identity), ongoing transaction monitoring, and suspicious activity reporting where a red flag is identified. This is not a one-off onboarding check: regulators and banks expect the framework to operate continuously, with periodic re-verification of clients and regular review of the framework itself against current typologies and regulatory updates.

  • What are the risks of non-compliance?

The risks of non-compliance extend beyond fines: a regulator can suspend or revoke a license, unwind or block a transaction already in progress, and in some jurisdictions hold directors personally liable, civilly or criminally, for failures on their watch. These risks compound rather than stay isolated, a licensing breach in one jurisdiction is often reportable to regulators or counterparties in others, so a single control failure can restrict the business's ability to operate well beyond where it occurred.

  • Why should companies review their compliance frameworks regularly?

Compliance frameworks need regular review whenever the underlying regulation changes, the business enters a new market or licensing regime, or its ownership, activities, or counterparties change in a way the framework wasn't built to cover. An annual review cycle, at minimum, catches the gap between what the framework was designed to handle and what the business and its regulatory environment actually look like now.
